SPREADING SMUCKER’S® TRADITIONS RECIPE AND ESSAY CONTEST OFFICIAL RULES

Spreading Smucker’s® Traditions Recipe and Essay Contest (“Contest”) begins on September 14, 2011 at 12:00 p.m. noon Eastern Time (ET) and ends on November 16, 2011 at 11:59 a.m. (ET) ("Contest Period").

 

HOW TO ENTER: Submit your original family recipe made with at least ¼ cup of one of Smucker’s jam, jelly, preserves, fruit spread, or fruit butter, the recipe name, and an original essay of 200 words or less (in English or Spanish) describing how the recipe is part of family traditions and how the recipe makes family celebrations special. 1) Online - Visit the Smucker’s website (www.smuckers.com or www.smuckersenespanol.com) during the Contest Period to access and complete the Contest Entry Form. To submit your entry, you must agree to these Official Rules and then click “Submit Entry.” Or, 2) By Mail - legibly hand-print or type your name, date of birth, complete address, daytime and evening phone numbers, e-mail address (if applicable), and include your original family recipe, recipe name, and your original essay. Mail your entry in a standard, business-size envelope to: Spreading Smucker’s Traditions Recipe and Essay Contest, C/O Cohn & Wolfe, 200 Fifth Avenue, 7th Floor, New York, NY 10010. Mailed entries must be postmarked by November 16, 2011 and received by November 23, 2011. Limit one entry per person/e-mail address, regardless of method of entry. Multiple entries will invalidate all entries from the entrant. All entries, including the recipe and essay submitted, become the property of The J.M. Smucker Company (“Sponsor”) and none will be returned.

 

ENTRY REQUIREMENTS: The Contest recipe entry must be an original work that was created by the adult entering the Contest and cannot have previously won a contest or other promotion. Recipe and essay entries must not have been previously published, must not be awaiting publication, nor may be submitted for publication consideration during the period of the Contest. Recipes must list all ingredients in exact common U.S. household measurements in order of use, step-by-step preparation instructions, cooking times and number of servings. Recipes containing alcohol will NOT be considered. Recipe must include at least ¼ cup of Smucker’s jam, jelly, preserves, fruit spread, or fruit butter as an ingredient. The flavor or variety of the Smucker’s product used in the recipe must be specified. Recipes may not include any other brand name product or the trademark of any other manufacturer, except for the Smucker’s family of brands (including Smucker’s, Jif®, Crisco®, Folgers®, Hungry Jack®, Martha White®, Pillsbury® (baking mixes, frosting and flour brands), Eagle Brand®, etc). Sponsor may disqualify a nonconforming recipe or, at its sole discretion, may modify such recipe (including the substitution of a generic ingredient) without notice to entrant. The entry must not violate or infringe the rights of any third party, including but not limited to rights of copyright, trademark, publicity or privacy.

 

ELIGIBILITY: The Contest is open to legal residents of the 50 United States and D.C., 18 years of age or older. Employees, officers and directors of Sponsor, its affiliates, subsidiaries, distributors, sales representatives, website developers and administrators, retailers, advertising, sales promotion and judging agencies and all other service agencies involved with the Contest, and members of the immediate families (parent, child, sibling and spouse of each) or households of any of the above are not eligible. The Contest is open only to amateur home cooks. Individuals who currently attend, have attended or who are graduates of an accredited culinary program (whether employed in a culinary trade or not) or who are employed as a food professional such as a chef, food writer, food editor, or food economist who create recipes for income are prohibited to enter and are not eligible to win a prize. Entries from anyone who has been a prize winner in any Sponsor (including Smucker’s, Jif®, Crisco®, Folgers®, Hungry Jack®, Martha White®, Pillsbury® (baking mixes, frosting and flour), Eagle Brand®, etc.) contest in the 12 months prior to the Contest start date will NOT be considered.

 

INITIAL JUDGING: Initial recipe judging will be done by a qualified panel of judges based on the written recipe and will consider the following criteria: likely taste, creativity, ease of preparation and nutritional balance. Essays corresponding to the recipes will be judged and equally weighted on relevance to theme, creative expression and clarity. Translated materials will be made available to the panel. The top 15-20 recipes will then be prepared and judged by a qualified panel of judges and assigned points based on the following criteria and point system: taste (1-50 points); creativity (1-15 points); ease of preparation (1-15 points); appearance (1-10 points); and nutritional balance (1-10 points). Essays corresponding to the top recipes will be judged on the following criteria: relevance to theme (1-10 points); creative expression (1-10 points); and clarity (1-10 points). Points from recipe judging and essay judging will be combined to determine the five finalists (“Finalists”). In the event of a tie, the entry with the higher score first in the taste category and then in the creativity category for the recipe and then the higher score in the creative expression category for the essay will determine the Finalist. If a tie continues, the tied entries will be re-judged by a new judge using the original criteria. The five potential Finalists will be chosen on or about January 11, 2012 and notified via telephone or mail. Each Finalist will be required to participate in a video demonstration of his/her entry. A professional videographer will be contracted by Sponsor to film at a location near or at the Finalist’s home. The video may be taped in English or Spanish. The video will include the Finalist demonstrating how his/her recipe is prepared, and explaining how the recipe is part of family traditions and makes family celebrations special. The video will not be judged. All videos will be filmed before February 17, 2012. Videos will not contain any identifiable person other than Finalist and videos must not include any intellectual property of third parties, including copyrighted material (including but not limited to music) or trademarks. Participation in the video (a) constitutes and signifies agreement that the Sponsor and/or the Sponsor’s assignees may use the video for promotional purposes in commerce and in all media worldwide now known or hereinafter developed without time limitation and without further compensation, except where prohibited, and (b) grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify the video in any way, in commerce and in any and all media worldwide now known or hereinafter developed, without time limitation and without further consideration. Finalists are subject to eligibility verification and cannot discuss their Finalist status with the public (including through social media) until notified by Sponsor or the public announcement is made.

 

FINAL JUDGING EVENT: Finalists will be announced to the public and their recipes and essays will be posted on the Sponsor’s website on or about February 8, 2012. Each of the Finalists will be required to attend the final judging event in New York, NY on or about March 8, 2012, at a location to be selected by Sponsor. At the final judging event, one at a time and in random order, each Finalist will briefly demonstrate the preparation process, for their recipe (in English or Spanish) and answer questions from a judging panel. A translator will be available. Sponsor will make reasonable efforts to provide all ingredients and cooking equipment (such as appliances, utensils, etc.) needed to successfully demonstrate the recipe at the final judging event. Sponsor reserves the right to substitute comparable products at its discretion. Following the recipe demonstration, each recipe will be tasted and scored by a qualified judging panel based on the same criteria and point system as in initial judging. Following the recipe tasting, each Finalist will read their original essay submission in English or Spanish to the judging panel. Judges will be provided with translated materials and a translator will be available. The essay reading must be verbatim and with no embellishment to the original submitted essay. The essay will be judged based on the same criteria and point system as in initial judging. After the final judging is completed, the Finalist with the most points will be declared the Grand Prize winner. In the event of a tie, the Finalist with the higher score first in the taste category and then in the creativity category for the recipe and then the higher score in the creative expression category for the essay will determine the Grand Prize winner. Finalists will be required to participate in a rehearsal the day before the final judging event. The rehearsal will be approximately 90 minutes in length and will consist of a walk-through of the final judging event with the opportunity to practice demonstrating their dish. If a Finalist is unable to participate in the final judging event, his/her status as a Finalist and Finalist Prize will be forfeited and an alternate Finalist will be selected, if circumstances permit. The Sponsor will provide round-trip coach airfare for each Finalist and one guest from the major airport nearest the Finalist’s U.S. residence to New York, NY and hotel accommodations (double occupancy) for two nights for each Finalist and his or her guest. The Sponsor will also provide ground transportation to/from the hotel and airport and to/from the hotel and the judging event. If Finalist is an eligible minor, he/she must be accompanied by a parent or legal guardian as his/her guest. If the Finalist lives within 100 miles of New York, NY, alternate transportation will be provided by the Sponsor in lieu of air travel and no cash difference will be awarded. All expenses not specified herein, including but not limited to taxes and gratuities are the sole responsibility of the Finalists. Grand Prize Winner will be announced to the public on or about March 15, 2012.

 

PRIZES:ONE GRAND PRIZE: A family reunion, awarded as a check for $20,000, and a personal planner for a family reunion awarded as a check for $1,000. FIVE FINALIST PRIZES: Each Finalist will receive one Gift Basket of Smucker's brand products. Approximate Retail Value (“ARV”) of Gift Basket is: $100.00 each, actual value depends on products selected. Total ARV of all prizes: $21,500. Prizes not redeemable for cash and no substitutions will be made, except by Sponsor who may substitute a prize of equal or greater value. All prizes will be awarded provided they are properly claimed in accordance with these Official Rules and a sufficient number of eligible entries are received and provided further that circumstances permit. Limit one prize per person, household, or family.

 

GENERAL TERMS & CONDITIONS: Sponsor’s decisions will be final on all matters relating to this Contest. Each potential Finalist and his or her guest will be required to execute an Affidavit of Eligibility, a Liability Release and (where legal) a Publicity Release. If potential Finalist fails to return such documents within seven days, or the potential Finalist is found to be ineligible, or if he/she does not comply with these Official Rules, then the potential Finalist will be disqualified and an alternate Finalist will be selected, if circumstances permit. If Finalist notifications are returned as undeliverable, this will result in disqualification and an alternate winner will be selected, time permitting. Finalists will also have to make themselves available for media interviews and public relations activities if appropriate. All Finalists must be available to extend their stay in New York, NY for one day at Sponsor’s cost for potential media requests. The Grand Prize winner may be required to travel and attend additional promotional appearances at Sponsor’s cost at the discretion of Sponsor during the five days after the final judging event. Prizes are non-transferable. No cash redemptions or substitutions permitted, except by Sponsor who may substitute a prize of equal or greater value if the featured prize or any portion thereof becomes unavailable. Winners are solely responsible for any federal, state or local taxes on prizes. All federal, state and local laws and regulations apply. Except where prohibited by law, acceptance of a prize constitutes permission for the Sponsor to use the name, photograph, likeness, statements, recipe/name (in whole, in part or altered in any way), biographical information, voice, video, and city and state address of Finalists (collectively “Publicity Materials”) on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. Finalists agree that their statements may be used in whole or in part and may be paraphrased, amplified, shortened, and/or put into conversational form to meet the requirements of copy, layout and/or script, provided their general sense is not changed, and hereby waive any right to inspect and approve finished Publicity Materials, and Finalists will not hold Sponsor responsible for any liability resulting from the use of the Publicity Materials. All Publicity Materials developed or used hereunder will be and remain Sponsor’s property, and Finalists specifically understand and agree that any copyrightable Publicity Materials will be works “made for hire” and Finalists will retain no ownership rights whatsoever in or to said works. If said Publicity Materials are not considered works “made for hire,” Finalists hereby assign all said works to Sponsor. All participants, Finalists also agree to release, discharge, indemnify and hold harmless Sponsor, its affiliates and subsidiaries, and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages, or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest. The Sponsor may prohibit any entrant from participating in the Contest at its sole discretion, if an entrant shows a disregard for these Official Rules or acts: (a) in a manner Sponsor determines to be unfair or inequitable, including but not limited to tampering with the Contest or the Contest website; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; or (c) in any other disruptive or illegal manner. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend this Contest should electronic viruses, other malicious software attacks, unauthorized human intervention, systems malfunctions, failures, difficulties or other causes beyond the control of the Sponsor and its agencies corrupt or affect the purpose, administration, security, fairness or proper play or conduct of the Contest. In such event, Sponsor will conduct the Contest in accordance with these Official Rules in a manner deemed fair, proper and equitable by Sponsor, in its sole discretion. If, for any reason, the Contest is not capable of running as planned by any cause which, in the sole opinion of the Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, or if due to any technical, production or other error, more prizes are claimed or awarded than are described in the Official Rules at any prize level, Sponsor reserves the right, at its sole discretion to cancel, terminate, modify or suspend the Contest and determine winners from entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. In case of cancellation, a winning entry will be chosen from all eligible Entries received prior to the date of cancellation and if circumstances permit. No more than the number of prizes stated in these Official Rules will be awarded. By entering, entrants agree and consent: (a) that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, will be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules, and (b) to the jurisdiction and venue of the federal, state and local courts located in Cleveland, Ohio with respect to any such claim or issue.

 

LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, such entry will be deemed to be made by the authorized account holder of the e mail address submitted at the time of entry. “Authorized account holder” is deemed as the natural person who is assigned to an e mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e mail addresses for the domain associated with the submitted e mail address. Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, or non-delivered entries or e-mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in the Contest and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Sponsor’s website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of the Contest or the Sponsor’s website, may be acting in violation of the terms of the Sponsor’s website or these Official Rules or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage any website or undermine the legitimate operation of the Contest is unlawful and subject to legal action by Sponsor or its agents.

 

IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES OR RELATED COMPANIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THIS CONTEST, INCLUDING ENTRANT’S ACCESS TO OR USE OF THE WEBSITE OR DOWNLOADING FROM AND OR PRINTING MATERIAL DOWNLOADED FROM SAID WEBSITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEBSITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
